Alternative dispute resolution could be the right choice for you

Alternative dispute resolution (ADR) is an important type of assistance to use when you're involved in a conflict. Whether you're fighting over your child's care after a divorce or want to fight for particular assets from your marriage, ADR can help you.

There are two main kinds of ADR that you can try if you and your ex-spouse or estranged spouse are willing to negotiate and listen to one another. They include:

  • Mediation
  • Arbitration

Mediation

Mediation is special because you and your spouse sit down together to talk through your disagreement. A third-party mediator is present to keep you on topic and to help you understand the legal implications of the decisions you may or may not make.

Mediation is good for people who can work together for the most part. The mediator can help keep tempers cooled and reduce tension, which helps you both move forward with whatever you need to discuss. Mediation isn't binding, but with a goal to make both parties happy, it's possible for you to come up with a solution that you can both agree on.

Arbitration

The next thing to consider if mediation won't work for you is arbitration. It varies from mediation because the arbitrator can create a binding result at the end of the session. The arbitrator may or may not be a judge.

With arbitration, each party presents their arguments. The arbitrator makes the final decision on what happens in terms of custody or whatever the dispute is over. The session is generally legally binding, giving you a result regardless of your feelings toward it.

These are two kinds of ADR. One might be a good choice for you, and they are something to look into.
