Terminating The Other Parent's Rights

To adopt your spouse's child, you first must obtain the consent of your spouse and the child's other parent. The other parent must agree to a permanent termination of his or her parental rights and responsibilities, including the right to visitation and the responsibility to pay child support.

The adoptive parent must undergo a criminal background check. A home study, typically required in other types of adoption, can be waived in these cases by the Department of Human Services.

The entire process can take up to six months.
